Painter terms

Contents 16 sections
These terms apply if you have, or apply for, a painter profile on Legion Gaming. They're a contract between you and us. Our website terms, including the content policy, also apply to you.
1. About us
Legion Gaming is a trading name of Legion Comps Ltd, a company registered in England and Wales with company number 17307226. Our registered office is Unit A 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom. Contact us at hello@legiongaming.co.uk or on 0800 000 0000.
2. What we provide, and what we don't yet
2.1 A painter profile lets you show your work, your styles, and the painting services and prices you offer, to people who visit Legion Gaming. Approved painters with a price tier for a type of kit may also be shown on matching shop product pages.
2.2 Commissions aren't open yet. Customers can't book or pay you through Legion Gaming. Your price tiers are shown for information only, under a "commissions opening soon" message.
2.3 When we open commissions, there will be separate commission terms. They'll cover things such as how customers book and pay, our fees, payouts, identity checks, what we must show customers about you, tax reporting, kit handling, and reviews. You won't be able to take commissions through Legion Gaming until you've seen and accepted them. These terms don't oblige you to accept them. If you don't, you can keep a profile that doesn't take commissions, or close your profile.
2.4 Having a profile is free. If we ever want to charge for it, we'll give you at least 15 days' notice, and you can close your profile before the charge applies.
3. Who can have a profile
3.1 To have a profile you must:
- be 18 or over and live in the UK;
- have a Legion Gaming account in your own name;
- paint the work you show yourself;
- give us accurate trader details (section 4).
3.2 One profile per person or business. You can't transfer your profile to anyone else.
4. You're a trader
4.1 By offering paid painting services on Legion Gaming, you're acting as a trader, even if painting is a sideline. That means consumer law applies to your dealings with customers, and you must not present yourself as a hobbyist or private individual when you're offering services for money.
4.2 Your trader details. You must give us your legal name, any trading name, a business address where you can be contacted (a geographic address, not a PO box), and a business email address, and keep them up to date. Only our staff can see these today. When commissions open, the law will require us to show some of them to customers before they buy from you; the commission terms will explain which, and how.
4.3 Your tax. You're responsible for your own tax, National Insurance and, if you're registered, VAT. We don't give tax advice. Your price tiers must show the price a customer would actually pay, including VAT if you charge it.
4.4 You're independent. You aren't our employee, agent or partner, and you mustn't say you are. You mustn't describe yourself as a "Legion Gaming painter" or suggest we've endorsed your work, beyond saying that you have a profile on Legion Gaming.
5. Your content
5.1 "Your content" means everything you put on your profile: your display name, bio, region, avatar and banner, portfolio pieces (images, titles, descriptions and tags), price tiers, and your replies to reviews.
5.2 You keep ownership of your content. You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, display, resize, crop, reformat and publish your content on Legion Gaming and in its emails, and to show it in posts and adverts that promote Legion Gaming's painter area or your profile. We'll credit you by your display name when we use your work outside your profile. You can ask us to stop using a particular image in our promotions, and we will, though we don't have to take down posts already published.
5.3 The licence ends when you remove the content or close your profile, except that we can keep copies in backups for up to 90 days, keep records we need for moderation, complaints or legal reasons, and leave in place promotions already published.
5.4 Your promises about your content. You promise that:
- you painted the work you show, and have said if anyone else helped;
- you took the photos, or have permission to use them;
- your content doesn't infringe anyone's rights, and follows our content policy, including the rules on Games Workshop and other brands (website terms, sections 5 and 6);
- your descriptions, styles, turnaround times and prices are honest, and a price tier is a price you'd really charge.
5.5 If someone makes a claim against us because your content broke these promises, you'll cover our reasonable costs of dealing with it.
6. Moderation
6.1 We check everything before it's published. Your profile text and images, portfolio pieces, price tiers and review replies all go to our team first. If you edit something that's already approved, it goes back to be checked again, and may not be shown until it's approved.
6.2 We can approve or reject your content, at our discretion and in line with our content policy. If we reject something, we'll tell you why, so you can change it and try again. If we reject an image, we keep it for 30 days so you can contest the decision, then delete it.
6.3 We aim to review new and edited content within 3 working days.
7. Reports and takedowns
7.1 Anyone can report your profile, a portfolio piece or a review. If a report is upheld, we may remove the content, hide a review, or suspend your profile. We'll tell you what we did and why, unless the law or someone's safety prevents it.
7.2 If we remove a portfolio piece or profile images because of a report, we delete the images straight away.
7.3 If content is, or we reasonably believe it may be, illegal, we'll remove it straight away. We may report it to the police or other authorities, and keep the records the law requires us to keep.
8. How painters are ordered on the site
8.1 We don't accept payment for a better position, and nobody gets one by paying.
8.2 The painter directory shows approved painters in alphabetical order of display name. Visitors can filter it by style, and by game system or faction (which uses the tags on your approved portfolio pieces).
8.3 Shop product pages show up to three approved painters who have an active, approved price tier for that product's type of kit. They're shown in alphabetical order of display name.
8.4 The home page shows a few approved painters, in this order: painters with approved portfolio pieces first; then painters who say they're taking commissions; then the newest profiles.
8.5 We'll update this section when any of this changes.
9. Reviews
9.1 When commissions open, only a customer who has completed a commission with you will be able to review you. Our review policy explains the rules.
9.2 You mustn't write, buy or arrange reviews of yourself or any other painter. You mustn't offer anything in return for a review, or for changing or removing one, or ask friends or family to review you.
9.3 You can't edit or remove reviews. You can publish one reply to each review, which we check first. If you think a review breaks our review policy, report it.
10. Keeping customers on the platform
10.1 While you have a profile, you mustn't use Legion Gaming to send customers elsewhere to commission you. In your profile, portfolio pieces, price tiers and replies, don't include:
- your phone number, email address or postal address;
- links or handles for other websites, social media or messaging apps;
- invitations to contact you outside Legion Gaming, or to pay you directly.
10.2 This doesn't stop you running your painting business elsewhere, or working with customers who found you some other way. It only covers using Legion Gaming to reach them.
11. Suspending or closing your profile
11.1 You can close your profile at any time by contacting us. We'll take it off the site, and delete your profile content within 30 days, apart from the records described in 5.3.
11.2 We can restrict or suspend your profile (for example, hide a piece, stop you editing, or take the profile off the site) if you break these terms, the website terms or the law, if we receive a credible complaint, or to protect customers, other painters or the site. Before or when we do it, we'll tell you why, by email, and how to complain (section 14).
11.3 We can end these terms and close your profile:
- with at least 30 days' notice, for any reason, giving you our reasons; or
- straight away, if the law requires it, if you've repeatedly broken these terms, or if you've seriously broken them (for example, by posting illegal content, someone else's work, fake reviews, or false trader details). We'll still tell you why, unless the law or someone's safety prevents it.
11.4 If we stop running the painter area altogether, we'll give you at least 30 days' notice.
12. Our responsibility to you
12.1 We provide the painter area as it is. We don't promise that it will bring you work, that commissions will open on any date, or that the site will always be available.
12.2 We're not responsible for loss of profit, loss of business or loss of opportunity, or for any loss that wasn't reasonably foreseeable.
12.3 Our total liability to you under these terms in any 12 months is limited to £100.
12.4 Nothing in these terms limits liability that can't legally be limited, including for death or personal injury caused by negligence, or for fraud.
13. Your data
We use your personal data, including your trader details, as described in our privacy notice, section 5. You must treat any personal data about customers or other users that you see on Legion Gaming as confidential, and only use it for its intended purpose.
14. Complaints
14.1 If you disagree with a moderation decision, a suspension, or anything else about how we run the painter area, complain using our complaints form, choosing "Painter account", or email hello@legiongaming.co.uk with "Painter complaint" in the subject line.
14.2 Someone who wasn't involved in the original decision will review it. We'll reply within 10 working days, with our decision and our reasons. If we were wrong, we'll put it right.
14.3 If we can't agree, we're happy to try mediation. Either of us can suggest a mediator, and we'll share the cost.
15. Changes to these terms
15.1 We'll give you at least 15 days' notice, by email, of any change to these terms, and say what's changing. If you don't agree, you can close your profile before the change takes effect.
15.2 We can make changes sooner if the law or a regulator requires it, or if we need to deal with an unforeseen risk to users. We'll tell you as soon as we can.
16. General
16.1 We may transfer these terms to another business that takes over the painter area. We'll tell you if this happens. You can't transfer them.
16.2 Nobody else has any rights under these terms.
16.3 If a court decides that part of these terms can't be enforced, the rest stays in force.
16.4 These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
