Terms of sale

These terms apply when you buy from the Legion Gaming shop at legiongaming.co.uk. Please read them before you order. They tell you who we are, how we sell to you, what to do if something goes wrong, and your rights to cancel.
Nothing in these terms takes away your legal rights as a consumer. Where we summarise those rights, the summary is for convenience; the law still applies in full. For free, independent advice, contact Citizens Advice on 0808 223 1133.
1. About us
1.1 Legion Gaming is a trading name of Legion Comps Ltd, a company registered in England and Wales with company number 17307226. Our registered office is Unit A 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom.
1.2 You can contact us by email at hello@legiongaming.co.uk or by phone on 0800 000 0000. If we need to contact you, we'll use the email address or phone number on your account or order.
1.3 "We", "us" and "our" mean Legion Comps Ltd trading as Legion Gaming. "You" means the person buying from us.
2. These terms
2.1 These terms apply to everything you buy from the shop: physical products we post to you (goods) and products you download (digital products).
2.2 You're buying as a consumer, for your own use and not for a business. If you buy for a business, contact us first; some of the consumer rights in these terms won't apply.
2.3 You can order with an account or as a guest. As a guest, you give us your name, email address and delivery address at checkout, and we use them to deal with your order. If you later create an account with the same email address and confirm it, or sign in to one, your guest orders will appear in it.
2.4 Painter profiles. The painter profiles on our site are for information only. You can't commission or pay a painter through Legion Gaming yet, and these terms don't cover painting services. When commissions open, we'll publish separate terms for them, and you'll see them before you order.
3. Our products
3.1 We describe each product as accurately as we can. Pictures are for illustration: colours vary between screens, and painted examples are for display only. Unless the product page says otherwise, models are supplied unassembled and unpainted, and you'll need your own tools, glue and paint.
3.2 Many miniatures have small parts and sharp points, and aren't suitable for young children. Read the product page and the manufacturer's warnings before you buy.
3.3 Age-restricted products. Some products, such as craft knives and aerosol paints, can only be sold to adults. We may refuse or cancel an order for an age-restricted product. Our courier may need to see proof of age at delivery.
3.4 We sell genuine products. Games Workshop, Warhammer and other brand names belong to their owners and are used to describe the products we sell. Legion Gaming isn't affiliated with, endorsed by or sponsored by Games Workshop or any other manufacturer whose products we stock.
4. Prices and payment
4.1 The price of each product is shown on its page. We aren't VAT-registered, so no VAT is charged.
4.2 Postage is shown and added before you pay. The total you see before you pay includes every charge you'll have to pay us. We don't charge extra for paying by card.
4.3 You pay by card through our payment provider when you place your order. We never see or store your full card details.
4.4 If a price on our site is plainly wrong (for example, a product shown at a fraction of its normal price because of a typing error), we'll tell you and you can choose to order at the correct price or cancel. If you've already paid, we'll refund you in full.
5. Your order
5.1 When you place an order, we hold the stock for you while you pay. Your order is accepted, and our contract with you starts, when we email you to confirm that your payment went through.
5.2 If we can't supply something you've paid for (for example, the last one was damaged in our warehouse), we'll tell you as soon as we can and refund you in full for that item, including its share of the postage.
5.3 You can see your orders, their status and any tracking number under Your orders in your account. If you ordered as a guest, your receipt email has a private link to your order page instead. Anyone with the link can see your order, so don't share it. Once the order appears in your account, the link stops working and you'll find the order there.
6. Delivery of goods
6.1 We deliver to addresses in the United Kingdom only.
6.2 We post your order by the method you chose at checkout, using Royal Mail or another courier. We aim to send it within the time shown at checkout. In any case, we'll deliver it within 30 days of accepting your order, unless we agree a different date with you.
6.3 If your order is late, contact us. If we've agreed a delivery date that's essential (for example, because you told us you needed it for an event), or we don't deliver within a further reasonable time you give us, you can cancel the order and get a full refund.
6.4 Your goods are our responsibility until they're delivered to you, or to someone you've asked us to deliver to. If your parcel is lost in the post, or arrives damaged, tell us and we'll send a replacement or refund you.
6.5 You own the goods once you've paid for them and they've been delivered.
7. Digital products
7.1 After your payment goes through, you can download digital products from your order page, while signed in to your account. If you ordered as a guest, download them from the order page linked in your receipt email, or from your account once the order appears there. There's no limit on how many times you can download them.
7.2 Before you can download, we'll ask you to agree that the download can start straight away, and to confirm that you understand you lose your right to cancel once it does. If you don't agree, you can't buy the digital product. We'll confirm your agreement in your order email.
7.3 We'll keep your downloads available for as long as we run the shop. If we ever plan to stop, we'll tell you at least 30 days before, so you can download your files. If we refund an order, or your bank reverses the payment, we'll remove access to its downloads.
7.4 Each digital product is licensed to you for your own personal, non-commercial use. You mustn't share, resell or publish the files, or use them to make copies for sale, unless the product page says you can.
7.5 If a digital product is faulty or doesn't match its description, tell us. You're entitled to a repair or replacement. If that isn't possible, or we don't do it within a reasonable time and without significant inconvenience to you, you can get some or all of your money back. If something you download from us damages your device or other digital content, and that's because we didn't take reasonable care, we'll repair the damage or compensate you.
8. Your right to change your mind (cancellation)
8.1 Goods. You can cancel your order for goods for any reason within 14 days of the day you (or someone you asked us to deliver to) receive them. If your order arrives in more than one parcel, the 14 days run from the day you receive the last one.
8.2 Digital products. You can cancel within 14 days of your order being accepted, but not after the download has started, because you agreed it could start straight away (see 7.2).
8.3 How to cancel. Tell us clearly that you want to cancel. You can email hello@legiongaming.co.uk, use the model cancellation form at the end of these terms, or write to us. You don't have to give a reason. It's enough to send your message before the 14 days end.
8.4 Returning goods. Send the goods back to Unit A 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom within 14 days of telling us you're cancelling. You pay the cost of returning goods you've changed your mind about, unless they're faulty or not as described. We recommend a tracked service, because you're responsible for the goods until they reach us.
8.5 Your refund. We'll refund the price you paid, and the standard postage you paid to have the goods delivered to you. If you chose a faster or more expensive delivery option, we only have to refund the cost of our cheapest standard option. We'll refund you within 14 days of the day we receive the goods back, or of the day you show us that you've sent them, whichever is first. If we haven't sent the goods yet, we'll refund you within 14 days of you telling us you're cancelling. We refund to the card you paid with, and we don't charge a fee for this.
8.6 Opened and handled goods. You can open the box and look at the goods, as you could in a shop. If you go further than that, and the goods lose value as a result, we can take that loss of value off your refund, up to the full price. For example, a kit with parts clipped from the frame, glued, filed, primed or painted can't be sold again as new.
8.7 Section 8 doesn't affect your rights if goods are faulty or not as described. Those are in section 9.
9. If something is wrong with your goods
9.1 We're required by law to supply goods that are of satisfactory quality, fit for purpose and as described. This is a summary of your main legal rights:
- Within 30 days of delivery, you can reject goods that are faulty or not as described, and get a full refund.
- After 30 days, or if you'd rather, you can ask us to repair or replace them. If that isn't possible, or doesn't fix the problem, you can get a refund or keep the goods for a reduced price. A refund after the first 30 days may be reduced to reflect the use you've had.
- Within six months of delivery, a fault is presumed to have been there when we delivered, unless we can show otherwise. After six months, you may need to show that the fault was there at delivery.
- You may be able to claim for up to six years from delivery (five years in Scotland).
9.2 Missing or damaged parts. Check your kit when it arrives. If parts are missing, broken or badly moulded, tell us (photos help) and we'll arrange replacement parts or a replacement kit. Where it's quicker, we may ask the manufacturer's customer service to send parts direct. You don't lose your rights against us if you choose not to use the manufacturer's service.
9.3 For faulty goods, we pay the reasonable cost of returning them to us.
10. Our responsibility to you
10.1 If we break these terms, or fail to use reasonable care and skill, we're responsible for loss or damage you suffer that was a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if we both knew it might happen when we made the contract.
10.2 We don't exclude or limit our liability where it would be unlawful to do so. That includes death or personal injury caused by our negligence, fraud, and breach of your legal rights described in sections 7.5 and 9.
10.3 We supply products for domestic and private use only. We aren't responsible to you for loss of profit, loss of business, business interruption or loss of business opportunity.
11. Events outside our control
If something outside our reasonable control (for example, a postal strike, a supplier failure or severe weather) delays your order, we'll tell you as soon as we can and do what we can to limit the delay. If the delay is significant, you can cancel and get a refund for anything you've paid for and not received.
12. When we can cancel your order
We can cancel an order, and refund you in full, if a product is out of stock or no longer available, if the price was plainly wrong (see 4.4), if we reasonably believe the order is fraudulent, or if you're not old enough to buy an age-restricted product. We'll tell you why.
13. Your personal data
We use your personal data as described in our privacy notice.
14. Other important terms
14.1 We may transfer our rights and obligations under these terms to another organisation. We'll tell you if this happens, and it won't affect your rights. You can only transfer your rights to someone else if we agree in writing.
14.2 Nobody else has any rights under this contract.
14.3 If a court decides that part of these terms can't be enforced, the rest stays in force.
14.4 If we don't insist straight away that you do something you have to do, we can still insist later.
14.5 We may change these terms from time to time. The terms that apply to your order are the ones on our site when you placed it.
15. Complaints and disputes
15.1 If you're unhappy, please tell us first, so we can put it right. Our complaints page explains how to complain and how long we'll take.
15.2 We aren't currently a member of an alternative dispute resolution scheme. If we can't resolve your complaint, you can get free advice from Citizens Advice, or take the matter to court.
15.3 These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in the courts there.
